US Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The case stems from a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his return to the United States to answer human smuggling allegations, he was held in immigration detention.
In her order, the court noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
Background of the Case
The legal challenge center on disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing trial in Tennessee.
